MEA Requests Minister to Delay Implementation Date of O. Reg. 406/19 - Onsite & Excess Soils Management

The MEA has reached out to David Piccini, Minister of the Environment, Conservation & Parks, requesting a delay in the implementation of the next phase of O. Reg. 406/19 (Onsite & Excess Soil Management) to January 1, 2023. Currently, the MECP is scheduled to implement the regulation on January 1, 2022.
The reasoning for the request is that guidance documents and fact sheets, which would enable municipalities to interpret the Regulation, have not yet been released and the Soil Registry is not in place. The delays are making it challenging for municipalities, which our members represent, to develop and finalize their internal processes and tender documents and implementing the new excess soils regime by January 1, 2022.
The Regional Public Works Commissioners of Ontario (RPWCO) recently made a similar request to the Minister.

The MEA encourages Ontario Municipalities to send letters of support regarding the delay in the implementation of O. Reg. 406/19.
