On March 14th 2022, the Ministry of the Environment, Conservation and Parks (MECP) advised the MEA that it was delaying the implementation of the next phase of Ontario Reg. 406/19: On-Site and Excess Soil Regulation (“Excess Soil Regulation”) until January 1, 2023.

In October of 2021, the MEA and Regional Public Works Commissioners of Ontario (RPWCO) reached out to the Minister of Environment, Conservation and Parks requesting a delay in the implementation by 1-year. This request was made  for several reasons, including delays in the MECP releasing guidance documents/fact sheets which would enable our members to interpret the regulations and that the Soil Registry was not yet in place. We advised these delays would make it very challenging for municipalities to develop and finalize their internal processes and tender documents and implementing the new excess soils regime in time for the original implementation date of January 1, 2022.
